Unmarried couples have limited legal rights. That’s because the terms ‘common-law wife’ and ‘common-law husband’ have no basis in UK law. 

Cohabitation agreements address this gap by providing a degree of protection and clarity in terms of assets, debts, and ongoing childcare.

A cohabitation agreement could:

  • Outline who owns your home – as well how mortgage payments are split (or rent for non  homeowners)
  • Define which bank accounts have joint access and, likewise, those which are for personal use only

Divorce law changed in April 2022. The language is now less archaic and more user friendly – with terms like ‘Decree Nisi’ being changed to ‘Conditional Order.’ Furthermore, contestations, dissolutions, and separations will be removed.
