Covid: Pandemic pet boom prompts ‘pet-nup’ advice

Given working dynamics have changed due to the pandemic with more people working from home, looking after a pet has never been easier. So, are ‘pet-nups’ the new thing?

Statistically, there has been a rise in pets with pet prices also increased given the demand during the pandemic.  Pets do, indeed, have the same legal status as a car, furniture or artwork. 

It has now become possible for couples to enter into a ‘pet-nup’ agreement which applies to both married couples as well as cohabiting couples. Couples who welcome pets during lockdown can consider making such an agreement to include who the pet belongs to and who they will live with should the relationship come to an end.

There is no law in the UK that makes nuptial agreements binding. However, the court will consider the agreement in reaching their decision on a fair outcome in the case. There is no reason why ‘pet-nups’ would not stand up in Court in the same way. Ultimately, the decision to enforce any nuptial agreement lies with the Family Court.

It is important in the judge’s view, so long as parties know what they were getting into and neither lied to, bullied or coerced the other to get them to agree, then any agreement made between them should be valid. The advantage of making a ‘pet-nup’ is to set up expectations early on, and to help avoid any disputes between the parties should their relationship break down. Ultimately you want to stay away from court to settle any dispute.
